Brian has decades of legal experience in both litigation and transactional work for clients primarily in the energy sector. Brian began his legal career in 1999 as a litigation attorney at the law firm of Farnsworth & vonBerg, LLP, assisting both oilfield service companies and operators in litigation matters including working interest owner disputes, collections, bankruptcy, personal injury, insurance, and trade secret litigation.
Several years into his legal career, Brian shifted his practice to transactional law, taking the lessons he learned in litigation and applying them to the contracts he drafts and negotiates for his clients, keeping them out of trouble and getting them paid. Brian has considerable experience in the negotiation of agreements for the energy sector, including oilfield service agreements, drilling contracts, bid package terms and conditions, contracts for goods and services, “take or pay” sales contracts, consulting agreements, water transfer and land agreements, non-disclosure agreements, and transportation and construction contracts.
Brian focuses his practice on the negotiation of oilfield master service agreements and he has negotiated hundreds of MSAs on behalf of major operators and large oilfield service companies including consultants, engineers, mud and chemical providers, coiled tubing providers, directional drillers, cementing companies, pressure control companies, snubbing providers, disposal providers, measurement services and EPC companies. Brian’s experience with oilfield master service agreements is virtually unparalleled as he has unique insight into the credit terms, liability risks, and other commercial and legal terms that certain service companies and operators are willing to accept without laboring through extensive contract negotiation.
During his 23-year tenure at Farnsworth & vonBerg, LLP, Brian maintained a relationship with Doré Rothberg Law, trusting the firm to resolve many of his clients’ lien and collection needs. Brian always envisioned being member of a firm that offers his clients a comprehensive “one stop” legal assistance solution. Brian’s plan came to fruition in 2023 when joined Doré Rothberg Law and Brian is now part of a team that can provide a “turnkey” business solution for his clients, from contact drafting and negotiation to debt recovery and collection.
Brian is a proud veteran of the United States Navy, serving in both Operation Desert Shield and Operation Desert Storm in 1990-1991. Outside of work, Brian enjoys spending “quiet” time with his wife Tera Shelton and their three boys Carter (16), Cole (14), and Conley (12).
